These Terms and Conditions (“Terms”) govern your use of the website and services operated by The Herdsman Market (“we”, “us”, “our”). By accessing our website or placing an order, you agree to be bound by these Terms.

1. General Information

The Herdsman Market is a fresh food retail store offering groceries, deli items, prepared meals, platters, hampers, seafood, butcher products, and related goods for in-store purchase and online ordering for pickup.

We reserve the right to update or modify these Terms at any time without prior notice.

2. Online Ordering & Acceptance of Orders

All orders placed through our website are subject to acceptance and availability.

We reserve the right to:

  • Accept or reject any order at our discretion
  • Cancel orders due to product availability, pricing errors, or unforeseen circumstances
  • Limit quantities on any product or category

If your order is cancelled, you will be notified and refunded where applicable.

3. Pricing & Payment

  • All prices are listed in Australian Dollars (AUD) and include GST unless otherwise stated
  • Prices may change without notice
  • Payment must be made in full at the time of ordering
  • We accept payment methods listed at checkout

4. Product Availability & Substitutions

Due to the nature of fresh food products:

  • Availability may vary daily
  • Seasonal or supply-based substitutions may be made where necessary
  • We will attempt to replace items with similar or higher-value alternatives where required

5. Click & Collect / Pickup Orders

  • All online orders are for in-store pickup only, unless otherwise specified
  • Pickup location: The Herdsman Market, 9 Flynn Street, Churchlands WA
  • Orders must be collected within the nominated time window
  • We are not responsible for quality degradation if orders are not collected on time

6. Fresh Food, Perishable Goods & Food Safety

Due to the perishable nature of our products:

  • We cannot accept returns or refunds for change of mind on fresh food items
  • All goods should be inspected upon pickup
  • Any concerns regarding quality or incorrect items must be raised immediately upon collection

We comply with all applicable Australian Food Safety Standards.

7. Cancellations

  • Orders may be cancelled prior to being prepared or fulfilled
  • Once preparation has begun, cancellation may not be possible
  • Custom or pre-ordered items (including platters, hampers, and catering orders) may not be eligible for cancellation

8. Refunds & Returns

Refunds or replacements will only be provided where required under Australian Consumer Law, including where:

  • Goods are faulty or unsafe
  • Items are not as described
  • Incorrect items are supplied

We do not provide refunds for:

  • Change of mind
  • Incorrect ordering by the customer
  • Failure to collect orders on time

Approved refunds will be processed using the original payment method.

9. Platter, Catering & Special Orders

For all grazing boxes, platters, hampers, and catering:

  • Orders may require minimum notice periods
  • Full payment may be required in advance
  • Cancellations may not be accepted within a specified preparation window
  • Ingredient substitutions may occur based on availability

10. Allergens

Our products may contain or come into contact with allergens including but not limited to:

  • Gluten
  • Dairy
  • Nuts
  • Seafood
  • Soy

While we take care in preparation, we cannot guarantee allergen-free environments. Customers are responsible for checking suitability before purchase.

11. Risk & Title

Ownership and risk of goods pass to the customer upon collection from our store. We are not responsible for damage, spoilage, or loss after collection.

12. Gift Cards

  • Gift cards are non-refundable and cannot be exchanged for cash
  • Gift cards are valid for the period stated at purchase (or as required by law)

13. Liability

To the maximum extent permitted by law:

  • We are not liable for indirect or consequential loss
  • We do not guarantee uninterrupted website access
  • Our liability is limited to replacement or refund of goods as required under Australian Consumer Law

14. Privacy

We collect personal information to process orders and improve services. Your information is handled in accordance with applicable Australian privacy laws.

15. Website Use

You agree not to misuse the website, including attempting to:

  • Interfere with system functionality
